Terms of Service

1. Introduction

Welcome to Job Refined ("we," "us," "our," or the "Platform"). Job Refined is an AI-powered career partner operated by Inflow Studio Pty. Ltd. (ABN 13 696 426 981, ACN 696 426 981), a company registered in Australia ("Company"). The Company operates Job Refined as one of its AI-powered products.

By accessing or using Job Refined at https://jobrefined.ai (the "Website"), our application programming interfaces, or any related services (collectively, the "Services"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Services.

These Terms constitute a legally binding agreement between you and Inflow Studio Pty. Ltd. (trading as Job Refined). Please read them carefully.

2. Eligibility

2.1. You must be at least 16 years of age to use the Services. If you are under the age of 18, you represent that you have your parent's or legal guardian's consent to use the Services.

2.2. By creating an account, you represent and warrant that:

(a) You are legally capable of entering into binding contracts;
(b) The information you provide during registration is accurate, current, and complete;
(c) You will maintain the accuracy of such information; and
(d) Your use of the Services does not violate any applicable law or regulation.

2.3. We reserve the right to suspend or terminate accounts that we reasonably believe are operated by individuals who do not meet these eligibility requirements.

3. Account Registration and Security

3.1. Account Creation. To access certain features of the Services, you must create an account by providing a valid email address and a password that meets our security requirements (minimum 8 characters, containing at least one uppercase letter, one lowercase letter, and one digit).

3.2. Email Verification. You must verify your email address before gaining full access to the Services. Verification links expire after 24 hours.

3.3. Two-Factor Authentication (2FA). We offer optional TOTP-based two-factor authentication with backup codes. We strongly recommend enabling 2FA for enhanced account security.

3.4. Account Security. You are responsible for:

(a) Maintaining the confidentiality of your login credentials;
(b) All activities that occur under your account; and
(c) Immediately notifying us at hello@jobrefined.ai if you suspect any unauthorized access to or use of your account.

3.5. Account Lockout. For security purposes, we implement tiered account lockout after repeated failed login attempts. After 5 failed attempts, your account may be temporarily locked for up to 3 minutes, escalating with further failures.

3.6. Single Sign-On (SSO). Where available, you may authenticate using third-party providers (such as Google). Your use of third-party SSO is also subject to that provider's terms of service.

4. Description of Services

4.1. Job Refined provides the following AI-powered career services:

(a) Resume Management — Upload, parse, and edit resumes in structured format;
(b) Job Description Parsing — Extract structured data from job descriptions via URL, text paste, or file upload;
(c) AI Resume Polish — AI-powered match scoring, gap analysis, ATS keyword optimization, and tailored suggestions with multiple variants (Conservative, Impactful, Bold);
(d) Cover Letter Generation — AI-generated cover letters with configurable tone, length, and emphasis;
(e) Application Tracking — Track job applications through a multi-stage pipeline (Draft → Applied → Interviewing → Offered → Accepted/Rejected/Withdrawn);
(f) AI Mock Interviews — Practice interviews with AI-generated questions based on actual job descriptions, with multi-dimensional scoring;
(g) AI Career Coach — Persistent AI chat assistant for career guidance;
(h) Export & Finalization — Export polished resumes and cover letters in PDF or DOCX format;
(i) Version History — Track changes and compare versions across polish and cover letter iterations;
(j) Rejection Learning — AI analysis of rejection feedback to improve future applications; and
(k) Notes & Reminders — Per-application notes and scheduled follow-up reminders.

4.2. AI-Powered Features. The Services use third-party Large Language Models ("LLMs") to provide AI features. You acknowledge and agree that:

(a) AI outputs are generated content and may contain inaccuracies, errors, or omissions;
(b) You are solely responsible for reviewing, verifying, and editing all AI-generated content before use;
(c) AI-generated content does not constitute professional career advice, legal advice, or a guarantee of employment outcomes;
(d) We implement anti-hallucination measures (including source attribution, fabrication detection, and grounding verification), but these measures cannot guarantee 100% accuracy; and
(e) AI model availability, performance, and capabilities may change without notice due to updates by third-party providers.

4.3. No Employment Guarantee. Job Refined is a tool to assist with your job search. We make no representations, warranties, or guarantees that use of the Services will result in job interviews, job offers, or employment.

5. Credit System and Pricing

5.1. Free Credits. Upon account creation, you receive 15 lifetime credits at no charge. Verified students receive 40 free credits. Free credits do not expire and are non-transferable.

5.2. Credit Packs. Additional credits may be purchased through the following packs (prices are in the currency displayed at checkout and include all applicable taxes):

5.3. Credit Consumption. Different features consume different amounts of credits:

Standard operations (JD parsing, resume analysis, match scoring, career advice): 1 credit per use;
Premium operations (resume polish, cover letter generation, iterations, mock interviews): 5 credits per use; and
Gap Fill: Free (no credits consumed).

5.4. Multi-Currency Pricing. Prices are displayed in your preferred currency. All prices are inclusive of applicable taxes (including GST for Australian customers). Currency conversion is based on prevailing exchange rates at the time of purchase.

5.5. Credit Validity. Purchased credits do not expire and remain available in your account until used or until your account is deleted.

5.6. No Refunds on Credits. Purchased credit packs are non-refundable once the transaction is complete, except as required by applicable consumer protection laws (including the Australian Consumer Law). See our Refund Policy for details.

5.7. Price Changes. We reserve the right to modify credit pack pricing at any time. Price changes will not affect credits already purchased. We will provide reasonable notice of material price changes.

6. BYOK (Bring Your Own Key)

6.1. BYOK License. For a one-time fee of AUD $29.99 (or equivalent in your currency), you may purchase a 12-month BYOK license that allows you to connect your own API keys from supported LLM providers (OpenAI, Anthropic, or Google Gemini).

6.2. BYOK Terms. When using BYOK:

(a) You are solely responsible for the cost of API calls made through your own keys;
(b) You must comply with the terms of service of the third-party LLM provider whose key you use;
(c) Job Refined encrypts your API keys at rest using AES-256-GCM encryption;
(d) You may revoke or change your keys at any time through the Settings page;
(e) The BYOK license grants a 50% discount on all credit pack purchases during the license period; and
(f) BYOK licenses are non-transferable and non-refundable.

6.3. BYOK Data Handling. When using BYOK with direct provider connections (e.g., direct OpenAI), Zero-Data-Retention (ZDR) enforcement depends on the provider's own policies. We cannot guarantee ZDR enforcement for direct provider connections. See our Privacy Policy for details.

7. Student Verification Program ("Refined for Graduates")

7.1. Students enrolled at recognized educational institutions may verify their student status using a valid university email address (e.g., .edu, .edu.au, .ac.uk, .ac.nz, .edu.sg).

7.2. Benefits. Verified students receive:

(a) 25 bonus credits on top of the standard 15 free credits (40 total);
(b) 20% discount on their first credit pack purchase; and
(c) Enhanced referral rewards (30 credits per successful referral, vs. 20 standard).

7.3. Verification Period. Student verification is valid for 12 months from the date of verification. You may re-verify to extend benefits.

7.4. Misrepresentation. Falsely representing student status to obtain benefits is a violation of these Terms and may result in account suspension, forfeiture of bonus credits, and/or termination.

8. Payment Processing

8.1. Payment Processor. All payments are processed by Stripe, a PCI DSS-compliant third-party payment processor. We do not store your full credit card number, CVV, or other sensitive payment details. We may store the last four digits of your card number and card type for display purposes only.

8.2. Taxes. All prices displayed on the Platform are inclusive of applicable taxes (including GST for Australian customers). Tax calculations are handled by Stripe Tax.

8.3. Payment Disputes. If you believe a charge is incorrect, please contact us at hello@jobrefined.ai before initiating a chargeback with your payment provider. We will work with you in good faith to resolve any billing disputes.

9. Referral Program

9.1. Registered users may invite others to Job Refined using a unique referral link.

9.2. Standard Rewards:

Referrer receives 20 credits per successful referral;
Referred user receives 10 bonus credits (25 total with base free credits).

9.3. Student-to-Student Rewards:

Referrer receives 30 credits per successful referral;
Referred student receives 15 bonus credits (40 total with student base).

9.4. Milestone Bonus. Upon reaching 5 successful referrals, the referrer receives an additional 50 bonus credits.

9.5. Abuse. We reserve the right to revoke referral credits and suspend accounts engaged in referral abuse, including but not limited to creating multiple accounts, using disposable email addresses, or any scheme to artificially inflate referral counts.

10. Intellectual Property

10.1. Our IP. The Services, including but not limited to the Website, software, algorithms, AI models (as configured and orchestrated by us), user interface, designs, logos, trademarks, and documentation, are owned by or licensed to Inflow Studio Pty. Ltd. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

10.2. Your Content. You retain ownership of all content you upload to or create through the Services ("User Content"), including resumes, cover letters, application data, and notes. By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to use, process, and store your User Content solely for the purpose of providing the Services to you.

10.3. AI-Generated Content. Content generated by AI features (including polished resumes, cover letters, interview feedback, and coaching messages) is provided for your use. You may use, modify, and distribute AI-generated content for your personal job search purposes. However:

(a) We make no representation that AI-generated content is original or free from third-party intellectual property claims;
(b) You are responsible for ensuring that AI-generated content does not infringe on the rights of any third party; and
(c) AI-generated content should not be represented as having been created by a professional resume writer, career counsellor, or other human expert unless you have substantially revised and personalized it.

10.4. Feedback. If you provide us with suggestions, ideas, or feedback about the Services, you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use such feedback for any purpose without compensation or attribution to you.

11. Acceptable Use

11.1. You agree not to use the Services to:

(a) Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable;
(b) Impersonate any person or entity, or falsely represent your affiliation with any person or entity;
(c) Fabricate, misrepresent, or embellish qualifications, experience, or credentials in resumes or other application materials;
(d) Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Services;
(e) Attempt to gain unauthorized access to any part of the Services, other users' accounts, or our systems;
(f) Use automated scripts, bots, scrapers, or other automated means to access the Services without our prior written consent;
(g) Circumvent or attempt to circumvent rate limiting, credit consumption, or any other technical measures;
(h) Engage in prompt injection, adversarial attacks, or any attempt to manipulate AI model outputs for malicious purposes;
(i) Use the Services to generate spam, phishing materials, or content intended to deceive employers;
(j) Resell, sublicense, or commercially redistribute the Services or AI-generated outputs;
(k) Upload malware, viruses, or other harmful code;
(l) Interfere with or disrupt the integrity or performance of the Services; or
(m) Violate any applicable local, national, or international law or regulation.

11.2. We reserve the right to investigate and take appropriate action against any violation of this Section, including suspending or terminating your account and reporting to law enforcement authorities.

12. Data Handling and Privacy

12.1. Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information.

12.2. AI Data Processing. By using AI-powered features, you acknowledge and consent to your data being processed by third-party LLM providers. We implement the following safeguards:

(a) PII Tokenization — Personal identifiable information (names, emails, phone numbers) is replaced with deterministic tokens before being sent to LLM providers and reversed after the response is received;
(b) Zero-Data-Retention (ZDR) — We enforce ZDR on all API calls routed through OpenRouter, meaning LLM providers do not store, log, or use your data for training; and
(c) Audit Logging — All AI interactions are logged (without content) for transparency and compliance.

12.3. Data Export. You may request a complete export of your data at any time through the Services or by contacting us.

12.4. Account Deletion. You may request deletion of your account and all associated data. Account deletion enters a 30-day grace period during which you may reactivate your account. After 30 days, all data is permanently and irreversibly deleted.

13. Third-Party Services

13.1. The Services integrate with or rely on the following categories of third-party services:

(a) LLM Providers — OpenRouter, OpenAI, Anthropic, Google (for AI features);
(b) Payment Processing — Stripe;
(c) Email — Resend (for transactional emails);
(d) File Storage — Amazon Web Services (AWS S3);
(e) Location Services — Google Places API;
(f) Hosting — Vercel (frontend), Railway (backend);
(g) DNS & Security — Cloudflare; and
(h) Memory & Vector Database — Mem0, Qdrant (for persistent career memory features).

13.2. Your use of the Services may be subject to the terms and conditions of these third-party providers. We are not responsible for the practices, policies, or actions of any third-party service provider.

13.3. We select third-party providers that maintain appropriate security standards, but we cannot guarantee their continued compliance. In the event that a third-party provider experiences a security incident affecting your data, we will notify you in accordance with applicable data breach notification laws.

14. Disclaimers

14.1. AS-IS BASIS. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

14.2. AI ACCURACY. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. AI OUTPUTS ARE PROBABILISTIC IN NATURE AND MAY CONTAIN INACCURACIES, OMISSIONS, OR FABRICATED INFORMATION DESPITE OUR ANTI-HALLUCINATION MEASURES.

14.3. AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

14.4. EMPLOYMENT OUTCOMES. WE DO NOT WARRANT OR GUARANTEE ANY EMPLOYMENT OUTCOMES, INCLUDING BUT NOT LIMITED TO RECEIVING JOB INTERVIEWS, JOB OFFERS, OR EMPLOYMENT AS A RESULT OF USING THE SERVICES.

14.5. THIRD-PARTY SERVICES. WE DISCLAIM ALL LIABILITY FOR THE ACTS OR OMISSIONS OF THIRD-PARTY SERVICE PROVIDERS, INCLUDING BUT NOT LIMITED TO LLM PROVIDERS, PAYMENT PROCESSORS, AND HOSTING SERVICES.

14.6. Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any equivalent state or territory legislation that cannot be excluded, restricted, or modified by agreement. If any provision of these Terms is inconsistent with such rights, the provision is to be read down to the extent necessary to give effect to those rights.

15. Limitation of Liability

15.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL INFLOW STUDIO PTY. LTD. (TRADING AS JOB REFINED), ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

(a) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
(b) ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
(c) ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES;
(d) ANY DAMAGES ARISING FROM AI-GENERATED CONTENT, INCLUDING INACCURACIES OR FABRICATIONS;
(e) ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR
(f) ANY DAMAGES ARISING FROM THE CONDUCT OF ANY THIRD PARTY ON THE SERVICES.

15.2. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (a) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM; OR (b) AUD $100.

15.3. THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15.4. Australian Consumer Law. This limitation of liability is subject to Section 14.6 above. Our liability for goods or services that are not of a kind ordinarily acquired for personal, domestic, or household use is limited, at our election, to: (a) re-supplying the services or paying the cost of having the services re-supplied; or (b) replacing the goods or paying the cost of replacing the goods.

16. Indemnification

16.1. You agree to indemnify, defend, and hold harmless Inflow Studio Pty. Ltd. (trading as Job Refined), its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

(a) Your use of the Services;
(b) Your violation of these Terms;
(c) Your violation of any third-party right, including any intellectual property right or privacy right;
(d) Content you upload, submit, or transmit through the Services;
(e) Your misrepresentation of qualifications, experience, or credentials in materials created using the Services; or
(f) Any claim by an employer, recruiter, or other third party related to application materials you created using the Services.

17. Suspension and Termination

17.1. By You. You may terminate your account at any time by requesting account deletion through the Settings page or by contacting us at hello@jobrefined.ai. Termination triggers a 30-day grace period before permanent deletion.

17.2. By Us. We may suspend or terminate your account immediately, without prior notice or liability, if:

(a) You breach any provision of these Terms;
(b) We are required to do so by law;
(c) We reasonably believe your account has been compromised;
(d) You engage in fraudulent, abusive, or illegal activity; or
(e) We decide to discontinue the Services (in which case we will provide reasonable notice).

17.3. Effect of Termination. Upon termination:

(a) Your right to use the Services ceases immediately;
(b) Unused credits are forfeited and are non-refundable (except as required by applicable law);
(c) We may delete your data in accordance with our data retention policies; and
(d) Sections 10, 14, 15, 16, 18, 19, and 20 of these Terms survive termination.

18. Governing Law and Dispute Resolution

18.1. Governing Law. These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of laws provisions.

18.2. Jurisdiction. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising out of or in connection with these Terms, subject to any rights you may have under consumer protection legislation to bring proceedings in your local jurisdiction.

18.3. Informal Resolution. Before initiating any formal dispute resolution, you agree to first contact us at hello@jobrefined.ai and attempt to resolve the dispute informally within 30 days.

19. General Provisions

19.1. Entire Agreement. These Terms, together with the Privacy Policy, Acceptable Use Policy, and Refund Policy, constitute the entire agreement between you and Inflow Studio Pty. Ltd. (trading as Job Refined) regarding the Services and supersede all prior agreements and understandings.

19.2. Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

19.3. Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19.4. Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

19.5. Force Majeure. We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or third-party service outages.

19.6. Notices. We may provide notices to you by email to the address associated with your account or by posting notices on the Website. You are responsible for keeping your email address current.

19.7. Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.

20. Changes to These Terms

20.1. We reserve the right to modify these Terms at any time. We will notify you of material changes by:

(a) Posting the updated Terms on the Website with a revised "Last Updated" date; and
(b) Sending an email notification to your registered email address.

20.2. Material changes will take effect 30 days after notification. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.

20.3. If you do not agree with the modified Terms, you must stop using the Services and may request account deletion.
